Battery Constituting Domestic Violence

In Nevada, a battery upon a person is classified as battery domestic violence when the battery is committed upon the following:

  • Current or former spouse
  • A significant other; someone you are dating
  • Someone living in the same home
  • The suspect’s minor child
  • A co-parent of the child or someone appointed as that child’s legal guardian
  • Any relative by blood or marriage

The definition of domestic battery is made when the assault is committed on someone with whom the suspect has, or has recently had, a close personal relationship with. Battery can range from a simple “offensive” touch, to Battery Domestic Violence with a Deadly Weapon causing substantial bodily harm. These charges carry serious penalties that go far beyond the obvious punishment handed out by the courts and:

  • Can negatively impact your employment opportunities and could even get you fired from your current job.
  • Can negatively affect future child custody or child visitation.
  • May disqualify you from owning or possessing a weapon.
  • Will disqualify you from obtaining a concealed weapons permit.
  • May disqualify you from admission to a college or a university.
  • Can affect your immigration status jeapordizing your ability to remain in the country.

So, it is plain to see that domestic violence charges must be fought aggressively with the help of an experienced and knowledgeable attorney. Someone who can help determine a proper defense such as: is there a case for self-defense? Were you simply trying to defend yourself as you have a right to do? Was someone else the “primary aggressor”? Were you falsely accused? Maybe you are being blamed for bruises or injuries that were already present when the altercation occurred. Prosecutors will aggressively pursue charges, but a good defense attorney can secure a plea bargain to less serious charges that will have far lesser impact on your future.
